Attorney Anthony Gemma practices in the areas of probate administration, probate litigation, will contests, and the drafting of comprehensive estate and trust planning, including Medicaid planning.
With more than thirty years of law practice, Mr. Gemma is a highly experienced litigator and trial attorney. Prior to commencing his civil practice, he served as an Assistant District Attorney in the Norfolk County District Attorney’s Office and the Middlesex County District Attorney’s Office. Attorney Gemma, prosecuted over 35 jury trials before the Superior Court, including high-profile criminal cases. Mr. Gemma also served as Chief of Narcotics Prosecutions for the Norfolk District Attorney. Since starting his own practice, he has continued his trial work through his representation of clients in probate litigation and will contests.
Representative probate litigation cases include helping clients defend a valid will from unwarranted challenges, or helping beneficiaries challenge the validity of a will due to undue influence, lack of testamentary capacity, fraud or some combination of those factors.
In 2015, Mr. Gemma earned an LL.M. in Taxation from Boston University School of Law, where his studies focused on advanced estate planning techniques, gift and estate tax issues, and fiduciary accounting.
Mr. Gemma’s estate planning practice is focused on helping clients develop the best estate plan for their needs, including probate avoidance and estate tax minimization, efficient asset transfer, achieving client’s goals, and protecting client interests during life through living trusts, living wills and durable powers of attorney. He also advises clients in Medicaid trust planning, and represents clients in guardianship and conservatorship matters, including petitions for court-established estate plans for incapacitated individuals.
In his probate practice, Mr. Gemma helps personal representatives with all aspects of estate administration. He provides guidance and takes the time to answer client questions when representing clients who are acting on behalf of estates as the estate legal representative.
Mr. Gemma is a member of the Massachusetts Bar Association Probate and a Committee Member of the Massachusetts Bar Association Elder Law Advisory Council. He is active in the Massachusetts Bar Association, where he has given annual presentations at local Councils on Aging on elder law and topical issues affecting seniors.
